Quick answer: Form W-8BEN is the IRS form a non-US individual gives to a US payer, broker or bank to confirm they are not a US person and, where eligible, to claim a reduced rate of US withholding under a tax treaty. A UK resident who is not a US citizen or green card holder typically uses it to cut US withholding on US dividends from 30% to 15% under the US–UK treaty. US citizens and green card holders living in the UK must not use Form W-8BEN — they use Form W-9 instead.
Who should use Form W-8BEN?
According to the IRS instructions, Form W-8BEN is for a nonresident alien individual who is the beneficial owner of income subject to US withholding, or who holds an account with a financial institution that needs to document their foreign status. Typical UK situations include:
- UK residents investing in US shares or funds through a broker or investment platform
- UK-based freelancers and contractors paid by US clients
- UK residents receiving US royalties, interest or other US-source income
Who must NOT use Form W-8BEN?
- US citizens (including UK/US dual citizens) and US resident aliens such as green card holders — use Form W-9, wherever you live.
- Companies and other entities — use Form W-8BEN-E.
- Income effectively connected with a US trade or business — Form W-8ECI.
- Intermediaries acting for others — Form W-8IMY.
This is a common and costly mistake. An American in the UK who signs a W-8BEN is certifying to the payer that they are not a US person. If you have done this, or have never filed US returns or FBARs while living in the UK, it is worth reviewing your US filing position — see our IRS Streamlined Filing and US tax return services.
What the US–UK treaty rate means on a W-8BEN
Without a valid form, a US withholding agent may withhold at 30% (or apply backup withholding). By completing Part II of the form (line 9: “United Kingdom”), an eligible UK resident can claim the treaty rate. The IRS treaty table for the United Kingdom lists, among others:
| US-source income type | General statutory rate | US–UK treaty rate (IRS Table 1) |
|---|---|---|
| Dividends paid by US corporations (general) | 30% | 15% |
| Interest (general) | 30% | 0% |
| Royalties (patents, copyrights, know-how) | 30% | 0% |
Your UK tax on that income is a separate matter: US tax withheld may be creditable against UK tax, but how it applies depends on your UK tax residence position (including whether the post-April 2025 foreign income and gains regime applies to you) and the type of account (for example, ISA and SIPP wrappers are treated differently). Our UK tax services cover Self Assessment for this kind of income.
UK freelancers paid by US clients
US clients often ask non-US contractors for a W-8BEN to document that they are not a US person. Payment for services you perform entirely outside the United States is generally not US-source income, so you would not normally need to claim a treaty rate for it. The income is still reportable to HMRC through UK Self Assessment.
Key rules from the IRS instructions
- Give it to the payer, not the IRS. The form goes to the withholding agent, broker or financial institution that requests it, before payment is made.
- Validity: generally from the date signed until the last day of the third succeeding calendar year (signed in 2026 → valid to 31 December 2029), unless your circumstances change.
- Change in circumstances: if information becomes incorrect — for example, you move to the US, obtain a green card, or stop being UK resident while claiming UK treaty benefits — you must notify the payer within 30 days and provide a new form.
- Foreign TIN (line 6a): generally required for accounts at US financial institutions receiving income reportable on Form 1042-S. For UK individuals this is normally your National Insurance number or Self Assessment UTR.
Frequently asked questions
I am a UK/US dual citizen. Can I use a W-8BEN as a UK resident?
No. US citizenship makes you a US person for tax purposes regardless of where you live, so you provide Form W-9. US citizens in the UK generally also need to file annual US returns and, where thresholds are met, FBAR (FinCEN Form 114) and FATCA Form 8938.
Does a W-8BEN mean I pay no tax?
No. It only affects how much US tax is withheld at source. UK tax on the same income is determined under UK rules.
How long does a W-8BEN last?
Generally until 31 December of the third year after the year you sign it, unless a change in circumstances makes it incorrect sooner.
